申請的時候 參考了前輩們的時程分享以及準備材料 獲益良多

現在自己終於也拿到了永居身分 覺得有必要分享出自己的經驗回饋給移民版


申請的背景:

* Category: EB2-NIW [non-concurrent]

* Publications: 17 co-authored papers (4 first author papers)

* Other: 3 referee journal reviews
* Reference Letters: 2 independent, 2 dependent (All US)

時程表:

04/12/2017 Contacted immigration lawyer (VC) for initial consulting
05/01/2017 Contract signed (approve or refund)
07/10/2017 Finished lawyer requested summary of contribution
08/15/2017 Accepted offer from start-up [也因此有一封推薦信變成非獨立...]
08/18/2017 Received recommendation letter templates from lawyer
09/04/2017 Collected all signatures from recommenders
11/06/2017 I-140 date of filing
12/15/2017 Renewal of OPT-STEM
03/2x/2017 Received new OPT-STEM EAD
05/05/2018 I-140 approved
05/08/2018 Continued contract with VC for I-485
07/12/2018 I-485/I-765/I-131 received by USCIS (Case直接到NBC)
[律師建議OPT-STEM拿到90天後再file I-485]
08/16/2018 Biometrics appointment at local office (Syracuse, NY)
11/09/2018 Received EAD/AP combo card
12/03/2018 Received interview notice
12/06/2018 Company lay-off everyone due to financial issue
01/09/2019 Interview at local office (Syracuse, NY)
01/10/2019 Card ordered
01/18/2019 Received green card

* 一開始律師建議的推薦信是 3 independent + 1 dependent, 但是接受了公司offer
以後, 其中一個independent變成dependent了, 原本以為要再找, 但律師表示沒有關係

* 由於OPT快要過期, 申請了OPT-STEM. 律師告知拿到OPT-STEM以後不馬上丟出I-485
的那個package, 說可能會有問題. 有一樣情況的可以算一下怎麼弄比較不會有gap time

* VC的I-140服務還不錯, 但是I-485的負責人有點小雷, 東西還是要自己仔細檢查看一下,
錯誤比如petition letter 國籍寫成Vietnamese...

* 出生證明直接拿戶籍謄本跟一個看起來很不像正本的醫院出生證明 -- no RFE

* 面試預約時間是早上八點
過安檢以後, 等待叫名字. (等待期間遇到插曲, 遇到一個非裔被安檢人員詢問是否
有攜帶刀槍炸彈等等危險物品時, 竟然說了 "Yeah, I've got them all", 造成不小的
騷動...後來發現他只是在開玩笑 = =")

面試是由一個帶著南方口音的老白女人進行, 一開始宣誓後說yes就逐題問I-485的
問題, 中間問了你自己一個人嗎?
回:太魯了,找不到對象.
面試官: 現在年輕人啊都用線上交友 你也該試試看 blabla... @@
然後剛好問到其中一題有關於polygamy的
面試官: Oh, you would like this question...

面試官只有問I-485的問題, 沒有跟我要任何東西 (連EAD/AP combo都沒跟我要...)
最後問到現在工作是什麼的時候 回由於公司經營不善 每個人都被lay-off了
面試官就說 她從來沒有遇過這個情況 她面試的所有EB2-NIW都有工作
所以要先把case put on hold請示上司進行檢查 期間讓我在大廳等待消息
等待了n個小時後 她說她連絡不到上司 建議我約下午infopass 可以讓我補證明資料

下午請示律師後跟爬了外國論壇 準備了下列的文件
1. Matter of Dhanasar文件 並且highlight了以下
"under sub paragraph (B) of section..., however, the Secretary of Homeland
Security may waive the requirement of a 'job offer'..."
2. Supplement J [非直接證明 說明不需要雇主]
"Note: Individuals seeking or granted a National Interest Waiver ... do not
need to file Supplement J"
3. USCIS網頁上EB2-NIW的說明 並且highlight了
"Alien seeking...that the Labor Certificate be waived..."

另外也準備了一些文件證明自己還是在同個領域貢獻 + 不會成為 public charge
For continuation of contribution:
1. Updated CV
2. Updated Google scholar page
3. Journal manuscript
4. Filed patent proof
5. Job interview emails
6. 整理出所有申請職位的excel表格
For evidence of not becoming a public charge
1. Bank statements
2. Stock statements

過一兩天後就看到online status改成 card being produced

一個禮拜後從USPS收到 green card
