Lawyer's message: because DOL incorrectly categorized your position as a
Marketing Manager, rather than as a Pricing Analyst. As I noted in the
request for redetermination, the wording used in the job description exactly
matches, in many instances, the wording in the Pricing Analyst DOL
description, so I am hopeful that this was just a careless oversight on the
part of the government. This happens quite a bit now, since they only have 2
analysts assigned to process Prevailing Wage Applications at the DOL. This is
why the process has slowed dramatically, and it is also the reason for all of
these mistakes. Unfortunately, there is nothing we can do but put forward our
best argument (which we have) and hope that they will come back with a
correct wage coding.

總共花了近21個月的時間,因為本身是一年OPT而已,中間實在是經歷了很多為了拿到身分
必經的路...從2016知道H1B沒抽到後找學校,年底學校被限制不能發I-20後轉學,到2017
年H1B重抽抽到,等到11月因為要準備file 140/485了不得不加急然後兩周內通過,順利在
12月送出,往後的流程就都很順了。
其中大約有6個月的時間被浪費,其一是我的PWD被弄了兩次,因為第一次DOL回來的職位變
成Manager而且薪水變兩倍,公司沒法負擔,所以重送;其二是我PERM 9/30/2016過,但當
時我的H1B還在被RFE,回覆了但還沒有消息,眼看11月了我的一年I-20(1/8/2017-1/7/201
8)就快到期必須要renew了,跟律師商量之後決定直接加急賭,雖然律師有說他們加急案件
裡面大約有50%被第二次RFE,不過公司也答應如果有要上新的學期學費也是公司出所以就
送吧,但還好結果是好的,約11月底H1B過,12月中把140跟485丟出去了。

關於H1B RFE,2017年被問的問題尤其多...所有的學校資料、職位資料、在美國是否維持
合法身分等等,洋洋灑灑四張滿滿的問題,有在CPT的各位其實只要把所有通勤或出席紀錄
都保持好就沒啥問題,剩下就是學校的Handbook,以及職位方面,我看到我的律師回覆的
資料裡把很多大公司的相同職位抓出來並指出這些都是需要怎樣學歷的,其實蠻有說服力
。

關於485面試,一早10:15到等約半小時10:45開始面試,面試官非常得Chill一直打哈欠說
早上沒咖啡很想睡,還跟我們抱怨說他一天要面試10個人,每個都要走一遍80題的485問題
,我跟我老婆就在旁邊陪笑的份XD。照相、對基本資料、問了所有485上的問題,問的時候
必須我跟我老婆分開回答。被問到現在是甚麼身分的時候,跟老婆一起說H1B,結果F1轉學
兩次及所有的I-20都沒被要求出示。
另外當問到是否有軍隊及武器訓練時,當時律師是幫我勾沒有,所以就跟面試官改一下,
被問了在哪邊當兵(National Defense)及到甚麼級職(Corporal),面試官會在最後一頁要
簽名的地方註記這題有改,然後簽名確認以上皆屬實。
最後這位面試官原本打算直接結束,問我有沒有甚麼問題,我跟我老婆就問說沒有要確認
婚姻關係嗎?面試官才說,喔對吼XD!其實律師的意思是說他沒問我們就別多說了,但我
們實在不想因為要確認關係再跑來面試一趟,所以就自己提出來。拿了以前住過一樣地址
的證明:Joint Account、Utility、Insurance、以及從學生時代就一樣的學生證、駕照等
等,我們還有另外準備我們美國當地的結婚證書,還有相本以備不時之需,只是面試官沒
要求要看相本。
整個過程很輕鬆就像在聊天,約莫1個小時。
