Employer's ability to pay - 移民

我現在為一個很小的一人consulting公司工作
想申請綠卡可是擔心I-140這部分過不了
因為公司的net income和profit都很低
不過我年薪夠高 一定會超過prevailing wage
只是我去年年中才加入現在公司 只有為公司做了半年
所以去年整年公司實際付給我的薪水是低於prevailing wage的

不知道它們在審查employer's ability to pay時
這樣夠不夠證明公司已經在付而且付得出我的薪水?


以下是我查的相關規定 想問的是第一項
How to establish the ability to pay the offered wage?
The ability to pay can be established by:

1) the employer actually paid the employee salary equal to or greater than
the offered wage, or

2) the employer's net income was equal to or greater than the offered wage,
or

3) the employer's net current assets were equal to or greater than the
offered wage.
