I-864 的exception - 移民

不好意思又來問問題

先交待一下我的背景

現在我是H-1B身份

前一陣子跟結婚(太太是公民)

現在自己填表申請綠卡

因為太太是學生 沒有收入

所以本來在煩惱 I-864 sponsor的問題

後來看到instruction 裡有exception

其中一個exception是:

Any intending immigrant who has earned or credited with 40 qualifying

quarters (credits) of work in the United States. In addition to their own work,

intending immigrant may be able to secure credit for work

performed by a spouse during marriage or by their parent(s) while the

immigrant were under 18 years of age.


讀到這裡有一些問題, 我去查了一下SSA的網站,

查到以下這段文字:

How You Earn Credits


You qualify for Social Security benefits by earning Social Security

credits when you work in a job and pay Social Security taxes.


The credits are based on the amount of your earnings. We use your work history to

determine your eligibility for retirement or disability benefits

or your family’s eligibility for survivors benefits when you die.



In 2009, you receive one credit for each $1,090 of earnings, up to

the maximum of four credits per year.


請問是不是我去年年薪比 $1,090*40 高就可以了嗎?

另一個問題是我去年是以OPT身份工作

所以去年不用繳Social security tax, 那這樣是不是我就沒有 credit earned呢?

所以就不滿足這個exception了呢?
