NIW 換領域 日後公民審查問題? CP 綠卡 - 移民

大家好 感謝前人開啟這串討論及各種推文提供各種意見


想follow up一下關於這個議題不知道近年來大家的看法有改變嗎

目前遇到NIW走CP在AIT拿到綠卡之後

會遇到可能轉換領域的問題


有可能的情況在原公司從材料化工化學領域的title換成 software engineer的狀況

可能是在AIT發還護照 蓋上入境章之後 入境美國之後的時間點換title


有問過VC旗下的律師 是建議

"Since your NIW I-140 is self-petitioned, it is fine if you change jobs as
long as you continue to work in the same or similar occupational
classification as that which was the basis for your I-140 petition. USCIS
usually determines this based on job title and job duties."


有風險被移民局撤銷綠卡:

"
Also, we generally recommend to our clients that they remain engaged in their
field of expertise fort least 6 monthsfter they receive the green card.
When you apply for an employment-based green card, you are saying that you
need the green card to continue your work in the field that is the basis for
your I-140 petition. If you then change your field too soon after receiving
your green card, USCIS could find that your I-140 was fraudulently filed. If
this happens, USCIS could revoke your approved I-140, your green card would
be invalidated, and you could be placed in removal proceedings (aka
deportation).[A"

日後的公民審查 即使是在原公司待著 但只是title change

這是不是也有極大風險呢? (前人討論推文是提及看每一個移民官的裁量權...)

感謝mha大的經驗分享，不曉得能不能麻煩您
撥空跟大家多分享一點轉公民的細節？

這樣我們這些NIW綠卡居民在糾結要不要（或
者精確的說，能不能）轉領域時，心中會比
較有個底。

網上各種說法都有，有人說一拿到綠卡就可
以立馬轉行，有人說至少要撐180天再轉，更
極端的還有人說在拿到公民前都不要轉。可
是具體移民局是怎麼審核實例少之又少，您
的經驗會有很大的參考價值。謝謝！
